A. Cancellation policy
Right of revocation
You have the right to cancel this contract within fourteen days without giving any reason.
The revocation period is fourteen (14) days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
In order to exercise your right of withdrawal, you must inform us (Mangelberger Elektrotechnik GmbH, Norisstraße 25 / Gewerbegebiet 3, 91154 Roth, Tel.: +49 (0)9171/9799-0, E-Mail: firstname.lastname@example.org) by means of a clear declaration (e.g. a letter or e-mail sent by post) of your decision to withdraw from this contract. You can use the enclosed model withdrawal form for this purpose, which is, however, not mandatory.
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.
You shall bear the direct costs of returning the goods. The direct costs of the return are estimated with regard to such goods, which cannot be sent back to us normally by post due to their nature (forwarding goods), for each such goods at a maximum of about 250 euros.
You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.
Exclusion or premature expiry of the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
1) Please avoid damage and contamination of the goods. Return the goods to us in the original packaging with all accessories and with all packaging components. Use a protective outer packaging. Please ensure adequate protection against transport damage with suitable packaging. Articles which you have received by forwarding agency are to be returned in the same way, standing on edge on a pallet, secured.
2) Do not send the goods back to us freight collect.
3) Please note that the aforementioned points 1 and 2 are prerequisites for the effective exercise of the right of withdrawal.
4) Please note that separate warranty conditions apply to our central energy management and market control systems. In the event of a warranty claim, the replacement controls are always sent with an invoice. After the defective parts have been returned and a guarantee case has been checked, a credit note will be issued. A warranty claim can only be made if the defective ZEMS control and/or the defective components are returned. If the defective part is not returned within 30 days, the full invoice amount will be due. We reserve the right to revoke the warranty claim and to invoice the full amount after the defective parts have been inspected by the manufacturer and it has been determined that the defective parts are the fault of the customer.
